1. Acceptance of Terms

By creating an account or using the Upkeep app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app. Your continued use of Upkeep constitutes your ongoing acceptance of these terms.

2. Service Description

Upkeep is a home maintenance guidance app that provides personalized maintenance schedules, task reminders, DIY instructions, and cost estimates. The app is designed to help homeowners stay on top of routine maintenance and plan for upkeep costs associated with their property.

3. Advisory Nature and Disclaimer

PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT LIMITATIONS ON THE NATURE OF OUR SERVICE.

Upkeep provides advice-based guidance only. The information, maintenance schedules, DIY instructions, and cost estimates provided by the app are opinions of the app and its operator, not approved expert opinions, professional assessments, or guarantees of any kind.

• Maintenance intervals and task recommendations are general guidelines. Different brands of appliances, different construction methods, different climates, and different countries — including Norway — may have different regulations, manufacturer requirements, and recommended maintenance intervals that supersede any guidance provided by this app.
• DIY instructions provided by the app are for informational purposes only. Attempting any maintenance or repair task carries inherent risk. Always assess your own skills and safety before proceeding.
• Cost estimates are approximate and based on general market data. Actual costs may vary significantly depending on your location, property, contractor, and materials.
• The author and operator of Upkeep take no responsibility for any issues, damages, losses, injuries, or costs arising from following the app's guidance, maintenance intervals, or DIY instructions. You use this information entirely at your own risk.
• For critical, structural, electrical, plumbing, or safety-related maintenance decisions, always consult a qualified, licensed professional in your area.

4. User Accounts

You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Upkeep is not liable for any loss or damage arising from your failure to protect your account information. You must be at least 18 years of age to create an account and use the service.

5. User Content

You are solely responsible for all content you upload to Upkeep, including photos, receipts, property images, and any other materials. By uploading content, you represent that you have the right to do so and that the content does not violate any applicable law or third-party rights. Upkeep does not review, verify, or moderate uploaded content and makes no representations about its accuracy or appropriateness.

You grant Upkeep a limited license to store and display your uploaded content solely for the purpose of providing the service to you. We do not claim ownership of your content.

6. Prohibited Content

You must not upload, share, or otherwise submit content that is:

• Illegal under applicable law
• Offensive, abusive, threatening, or harassing
• Infringing on the intellectual property rights of others
• Harmful to minors
• Containing malware, viruses, or other malicious code

Upkeep reserves the right to terminate accounts that violate this policy without prior notice and without liability to you.

7. Intellectual Property

All app content, including but not limited to task templates, maintenance guides, interface design, graphics, and text, is the property of Upkeep and is protected by copyright and other applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the app without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Upkeep and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, property damage, or personal injury, arising out of or in connection with your use of — or inability to use — the service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you have paid to us in the twelve months preceding the claim, or NOK 100, whichever is greater.

9. Modifications

We reserve the right to modify these Terms of Service at any time. When we make changes, we will update the "Last updated" date at the top of this page. We may also notify you through the app. Your continued use of Upkeep after any modifications constitutes your acceptance of the updated terms. If you do not agree to the modified terms, you must stop using the service.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Norway. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Norway.
